Indiana Teacher Accused in Student Sex Case Finalizes Divorce
INDIANA — An Indiana teacher facing dozens of criminal charges related to alleged misconduct involving students has finalized her divorce from her husband, according to court records cited by the New York Post and TMZ.
Brittany Fortinberry, 33, and her husband, Nicholas Fortinberry, finalized their divorce Monday, more than a year after Nicholas filed to end the marriage.
The divorce proceedings are separate from the criminal case, in which Brittany Fortinberry has denied or is presumed innocent of the allegations unless proven guilty in court.
Husband Receives Custody
Under the divorce settlement, Nicholas Fortinberry was awarded sole legal custody of the couple’s child while Brittany awaits trial.
The agreement reportedly allows custody arrangements to be reconsidered if Brittany is released.
The couple also sold their former home and divided the proceeds. Brittany was awarded her personal belongings, including clothing, shoes and makeup, while Nicholas received two vehicles.
Criminal Case Remains Pending
Fortinberry faces 47 criminal charges, including allegations involving sexual misconduct with a minor, contributing to the delinquency of a minor and distributing material considered harmful to minors.
Prosecutors allege that some students were provided alcohol and drugs and that sexual activity involving minors occurred.
Police have also alleged that masks associated with the Scream horror franchise were used during at least one incident.
The alleged victims included teenagers as young as 13, making the case particularly serious.
Divorce Comes as Trial Approaches
Court documents reportedly list February 21, 2025 as the couple’s separation date, around the period when the criminal allegations became public.
The divorce does not resolve Fortinberry’s criminal case. She still faces the pending charges and could receive a lengthy prison sentence if convicted.
For now, the custody arrangement means her husband will remain responsible for their child while the criminal proceedings continue.
The divorce closes one chapter of Fortinberry’s personal life, but the much more consequential criminal case is still ahead.
