NEW YORK — Phoebe Gates, daughter of Microsoft co-founder Bill Gates, is facing scrutiny after reports alleged that her shopping startup, Phia, used a controversial affiliate-marketing practice that may have caused the company to receive credit for sales it did not generate.
The allegations involve a practice known as “cookie stuffing,” which can manipulate online tracking systems used to determine which company receives an affiliate commission from a purchase.
What Is Cookie Stuffing?
Phia operates a shopping browser extension designed to help consumers find discounts and deals while shopping online.
Affiliate marketing normally allows a company to receive a commission when its referral directly contributes to a customer’s purchase. The allegations against Phia center on software features that reportedly placed tracking cookies even when shoppers had not intentionally used Phia to make a purchase.
Reports based on internal company communications allege that executives were aware of the practice months before it became publicly known.

Phia Disputes the Allegations
Phia previously described the issue as a software problem and said the features responsible for the disputed transactions were removed in July.
The company has said it is working to reverse transactions that may have been incorrectly attributed to Phia and plans to strengthen its compliance procedures.
The allegations have not resulted in a criminal conviction against Gates or her co-founder, and there is no indication that Gates has been formally charged with a federal crime.

Why Is a 20-Year Penalty Being Mentioned?
Reports have cited a potential 20-year maximum prison sentence, but that figure relates to the federal wire-fraud statute and does not mean Gates currently faces a 20-year sentence.
For such a penalty to become relevant, prosecutors would first need to bring charges and prove the required elements of a federal offense in court.
